Outcome achieved

The Social Insurance Package Law was adopted by the Parliament in July 2023. The key highlights of the law reform include (i) prohibition of retroactive payment of contributions (buyback), and (ii) deduction of the herders' contribution from the Government subsidies for animal originated raw materials.

ILO's contribution to the outcome

The ILO, through the UN Joint Programme (UNJP) on Extending Social Protection to Herders with Enhanced Shock Responsiveness, funded by the UN Joint SDG Fund, supported the preparation of Government and social partners to revise the social insurance law since 2015, including under the regional ILO/Japan Project on Income Security and Employment Services in ASEAN, Mongolia (ILO/Japan MAPS Project). Research was conducted on the "Study on Herders' Behaviour towards Social and Health Insurance" and "Social Protection Diagnostic Review and Financing Strategy (SPDR & FS)” and social dialogue was facilitated on the findings and recommendation from research studies. A comprehensive ILO policy note contributed to the ongoing discussion on the revision of the Social Insurance Package Law. It highlighted the importance of a shift from voluntary to compulsory insurance and the inclusion of specific tailored features for herders, such as the subsidization of contributions and the proposal for different contributory categories. The study proposed concrete recommendations which included suspending the clause on retroactive payment of social insurance contributions which has been reflected in the law, improving the legal environment for herders to actively participate in the social insurance programme, adapting contributions to herders' financial capacity, promoting young herders to participate in the social insurance programme through reduced contributions, ensuring and incentivizing contribution collection and compliance, increasing the number of social insurance officers and strengthening their capacity, facilitating access to social insurance services and improving knowledge of, and attitudes towards, social security schemes. ILO provided technical support to the Ministry of Labour and Social Protection (MLSP) on pension policy development by enabling 2 specialists to attend the ITC-ILO Executive E-Learning on Pension Policy and Management online course.

Gender equality & non-discrimination

The social protection analysis includes sex-dissaggregated data and recommendations concerning social insurance schemes. The recommendations support equal opportunities for men and women, as well as the reduction of inequalities and discrimination on other grounds, e.g. informal and formal workers.
